Besluit:
Commissaris Hogan zal worden uitgenodigd op de vergadering van de AGRIcommissie van 12 oktober voor een gedachtewisseling over de bepalingen in
dit voorstel die betrekking hebben op landbouw.
De commissie zal haar grote ontevredenheid uitspreken over de vorm van het
voorstel en de artificiële opname van substantiële bepalingen met betrekking
tot het GLB in een voorstel met een budgettair en financieel karakter.
Er zal alles aan worden gedaan om de exclusieve bevoegdheid van de AGRIcommissie met betrekking tot wijzigingen in de vier basishandelingen inzake
het GLB te handhaven.
Er zal worden gevraagd het voorstel te splitsen en de bepalingen die vallen
onder de exclusieve bevoegdheid van de AGRI-commissie, eruit te verwijderen
en afzonderlijk te behandelen met de AGRI-commissie als commissie ten
principale.

Er moet voort worden overlegd tussen de fracties over de vraag of deze

Netwerk PETI-commissie
Besluit:
6.3.
Er moet voort worden overlegd tussen de fracties om overeenstemming te
bereiken over een rapporteur en een plaatsvervanger voor deelname aan het
PETI-netwerk, met assistentie van het AGRI-secretariaat.
Mogelijke AGRI-initiatieven let betrekking tot de crisis in de graansector en andere
grondbewerkingssectoren
Besluit:
6.4.
Een vertegenwoordiger van DG AGRI moet worden uitgenodigd op de
volgende vergadering van de AGRI-commissie voor een presentatie over dit
onderwerp. Op basis hiervan zullen de coördinatoren besluiten of met
betrekking tot deze kwestie verdere stappen moeten worden ondernomen.
Afrikaanse varkenspestvirus
Besluit:
Een vertegenwoordiger van DG SANTE moet worden uitgenodigd op een van
de volgende vergaderingen van de AGRI-commissie voor een update over de
verspreiding van dit virus in bepaalde delen van Europa en de maatregelen die
worden genomen ter bestrijding ervan.
7.
HOORZITTINGEN EN WERKBEZOEKEN
7.1.
Hoorzittingen eerste helft van 2017 (januari - juni)
Besluit:
De AGRI-commissie neemt in haar ontwerpprogramma voor hoorzittingen
tijdens de eerste helft van 2017 het volgende op:
een hoorzitting over de conclusies van de Task Force landbouwmarkten (onder
voorbehoud op 9/1/17),

een hoorzitting over duurzame gewasbescherming,

een hoorzitting over de situatie van de EU-bijenteeltsector.
7.2.

Delegaties eerste helft van 2017 (januari - juni)
Besluit:
De AGRI-commissie neemt in haar ontwerpprogramma voor
delegaties/missies tijdens de eerste helft van 2017 het volgende op:
een missie naar de Groene Week in Berlijn (ergens tussen 20 en 29/1/17 - er moet dus
van het Bureau een vrijstelling worden verkregen van de verplichting om
verplaatsingen te maken tijdens “turquoise” weken),

Er bestaat ook een akkoord over de opname in het toekomstige

Subject: Opinion on petition No 0971/2012 concerning the transport of live animals in
the European Union
Dear Ms Wikström,
Thank you very much for your letter of 1 July 2016, with which you forwarded the abovementioned petition to the Committee on Agriculture and Rural Development for its opinion.
The petitioners seek revision of Regulation (EC) No 1/2005 on the protection of animals
during transport and related operations. They claim that, every year millions of live animals
are transported to abattoirs under unacceptable conditions in the EU and many animals die
during transport. They ask the European Parliament to arrange for rules to be adopted
imposing a limit of 8 hours’ transport for animals being taken to abattoirs.
The AGRI Coordinators considered the issue raised in this petition at their meeting of 26
September 2016.
Transport of live animals is regulated by Council Regulation (EC) No 1/2005 on the
protection of animals during transport. The introduction of a maximum eight hours transport
time limit for animals intended for slaughter would, indeed, require a change of that currently
applying Regulation.
I wish to point out that Parliament has expressed, on several occasions, a strong interest in the
issue of transport of live animals. In particular, in its Declaration No 49/2011 on the
“establishment of a maximum 8-hour journey limit for animals transported in the European
Union for the purpose of being slaughtered”, Parliament pointed out that Regulation 1/2005
itself is acknowledging in its recitals that ‘the transport of animals over long journeys,
including animals for slaughter, should be limited as far as possible’. However, as Parliament
underlined in the same Declaration, Regulation 1/2005 still allows very long transports in
terms of distance and duration, causing animals severe distress, suffering and even death
during such journeys. Therefore, paragraph 2 of the Declaration called on the Commission
and the Council to review Regulation 1/2005 to establish a maximum 8-hour limit for the
journeys of animals transported for the purpose of being slaughtered.

on Agriculture, Parliament adopted on 12 December 2012 a resolution on the protection of
animals during transport. That resolution first took note of the Commission report of 10
November 2011 ‘’on the impact of Council Regulation (EC) No 1/2005 on the protection of
animals during transport” (COM(2011)0700) where the Commission had pointed out that
problems during animal transport persisted due mainly to poor compliance and
implementation in the Member States. Parliament, called thus on the Commission to ensure
an effective and uniform enforcement of existing EU legislation on animal transport across all
Member States, while it strongly condemned the “weak scientific basis and data on which the
Commission report was based, such as a study from an external contractor based mainly on a
survey to be completed by parties directly involved in or having a direct interest in the
transport of animals”. Besides, Parliament, though acknowledging its Declaration No 49/2011
supporting an eight-hour journey limit for animals to be slaughtered, recognised that such a
demand alone had no scientific basis. Parliament considered rather that ‘’animal welfare
during transport in some instances depended more on proper vehicle facilities and on the
proper handling of animals, as documented in the EFSA opinion of December 2010”.
Nevertheless, Parliament asked the Commission and the Member States to lay down
guidelines for best practice with a view to improving the implementation of Regulation
1/2005 and to reinforce control mechanisms in order to guarantee animal welfare. Parliament
also highlighted the fact that, as the Commission’s report itself had stressed in its conclusions,
in agreement with the opinion of EFSA, ‘’it appeared that parts of the Regulation were not
fully in line with the current knowledge’.
Moreover, in its above-mentioned resolution, Parliament:
- welcomed the information on the introduction of a navigation system for monitoring the
transport of animals, but expressed disappointed that large differences in implementation
existed between Member States;
- requested that the Commission make legislative proposals before 1 January 2014, aimed at
creating an EU-wide common framework for data collection and control through satellite
navigation;
- urged the Commission to ensure that veterinary controls on animals to be transported take
place at the end of their transport;
- noted that any deficiencies in implementation were frequently the result of legal
requirements which could not be implemented in practice or which were incompatible with
national law, and called on the Commission to check the current Regulation for such
incompatibilities;
- called on the Commission to pursue legal action against, and impose sanctions on, those
Member States which failed to apply the Regulation correctly, and called on the Member
States to strengthen controls across the entire production chain in order to halt practices that
infringed the Regulation, such as allowing overstocked vehicles to continue their journeys, or
permitting control posts with inadequate facilities for resting, feeding and watering the
animals to continue in use.
However, the Committee on Agriculture is informed that the Commission still does not plan
to amend the legislation currently in force. The Commission claims, instead, that a stable legal
situation would allow Member States and stakeholders to better focus on enforcement of the
existing rules. To this end, the Commission refers to initiatives described in its report of
November 2011 on animal welfare during transport.
Furthermore, the Commission recalls that the responsibility for the enforcement of the EU
animal welfare legislation rests with the Member States, and that, in order to improve the

cooperation on these matters, the Commission organises twice a year meetings of Member
States represented by their National Contact Points on animal welfare during transport. The
Commission acknowledges that, thanks to the financial support of the European Parliament, it
has launched a three year pilot project on best practices for animal transport whereas the key
stakeholders involved include farmers, transporters, traders, slaughterhouse operators,
veterinarians, the competent authorities, organisations of animal protection and animal
welfare scientists. The Commission is confident that this recently launched pilot project
should play a key role in enhancing the level of implementation of the EU legislation.
The Committee on Agriculture and Rural Development will be closely monitoring the
developments concerning animal transport, especially as regards the implementation of that
pilot project.

Subject: Opinion on petition No 0108/2015 regarding the establishment of specific
labelling on meat produced by using farming methods which respect animals and the
environment
Dear Ms Wikström,
Thank you very much for your letter of 21 June 2016, with which you forwarded the abovementioned petition to the Committee on Agriculture and Rural Development for its opinion.
The petitioner calls for the establishment of specific mandatory labelling for meat on the basis
of welfare conditions under which animals were reared. In this regard, he points out that there
are two types of meat currently marketed in Germany: from conventionally and organically
reared animals. The petitioner takes the view that such mandatory labelling would give an
economic incentive to farmers to introduce improved breeding methods, and proposes the
gradual introduction of labelling, starting from raw meat, and its subsequent spread to other
types of meat.
The AGRI Coordinators considered the issue raised in this petition at their meeting of 26
September 2016.
It should be pointed out that the European Parliament has repeatedly expressed its interest in
such matters. Parliament, with its resolution of 11 November 2010 on the crisis in the EU
livestock sector (P7_TA(2010)0402), asked the Commission “to consider, as part of the next
CAP reform, specific measures to prevent serious losses of EU support for livestock farmers
that employ sustainable production methods”. Also, in its resolution of 12 March 2014 on
“the European gastronomic heritage: cultural and educational aspects” (P7_TA(2014)0211),
Parliament recognised that the present and future health and well-being of the population is
determined by diet and the environment and hence by farming and livestock breeding
methods.
In particular, Parliament’s resolution of 4 July 2012 on the European Union Strategy for the
Protection and Welfare of Animals 2012–2015 (P7_TA(2012)0290) urged the Commission to
accelerate its evaluation on the labelling of meat from animals slaughtered without stunning,
and highlighted that the question of consumers not being informed as to whether or not the
meat they are buying is from animals slaughtered without stunning is an issue of great public
interest for reasons of both transparency and animal suffering; however, it underlined that

labelling is not an alternative to proper enforcement as it can only guide consumers if the
information provided is verified and correct. It recalled Parliament’s view that a Framework
Law in this matter should not prevent producers from introducing voluntary systems which go
beyond EU rules and that those systems should be science based and could be promoted by
certified and cohesive labels; lastly, it called on the Commission to build on its
communication COM(2009)0584 by producing a study, if appropriate accompanied by
legislative proposals, on EU-wide labelling schemes for meat and dairy products, aimed at
informing consumers about the farming methods used, and their impact on the welfare of
animals, to achieve the maximum effective and consistent transparency and communication
to consumers.
The Regulation currently in force in this field is Regulation (EU) No 1169/2011 which lays
down harmonised rules for the minimum mandatory information to consumers. In fact, the
minimum mandatory information required by that Regulation does not include information on
welfare conditions under which animals were reared, nor on sustainable forms of production.
The Regulation allows, nevertheless, for the voluntary indication of such information,
provided the information is not misleading, ambiguous or confusing and it is based on
relevant scientific data. Moreover, Member States do have the possibility to introduce
additional labelling obligations for food business operators at national level, provided they are
justified on grounds, inter alia, of protection of consumers. Member States are required to
notify such additional labelling obligations at the draft stage to the Commission and to other
Member States. The Commission can object to the adoption of such draft measures following
consultation of Member States’ representatives.
Regulation 1169/2011 only entered into application at the end of 2014, so that it is still
considered relatively new. The Commission is cooperating with Member States to ensure its
harmonised application.
